Welcome to Houselyt. These Terms and Conditions govern your use of the website located at houselyt.com and the roofing, maintenance, and home improvement services provided by Houselyt.
By accessing our Site or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately cease use of the Site and our services.
1. Use of the Website
1.1 Eligibility
By using this Site, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.
1.2 License to Use
We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes, such as researching roofing services, requesting quotes, and managing your account.
1.3 Prohibited Conduct
You agree not to:
Use the Site for any unlawful purpose.
Attempt to gain unauthorized access to our systems or user accounts.
Use any “robot,” “spider,” or other automated devices to monitor or copy our web content.
Post or transmit any fraudulent, defamatory, or obscene material through our contact forms.
2. Service Requests and Contracts
2.1 Estimates and Quotes
Any quote or estimate provided through the Site is a preliminary assessment based on the information you provide. A binding contract is only formed once a physical inspection has been conducted, and a formal Service Agreement is signed by both parties.
2.2 Accuracy of Information
You agree to provide accurate and complete information regarding your property’s condition and ownership. Houselyt is not responsible for delays or cost increases resulting from inaccurate information provided by the client.
3. Payment Terms
3.1 Payment Schedule
For major roofing projects (Installations and Replacements), payment is typically structured as follows:
Deposit: A percentage of the total project cost is due upon signing the Service Agreement to secure materials and scheduling.
Progress Payments: For large-scale commercial projects, payments may be due at specific milestones.
Final Payment: The remaining balance is due immediately upon completion of the project and final walkthrough.
3.2 Late Payments
Late payments shall accrue interest at a rate of 1.5% per month or the maximum rate permitted by law. Houselyt reserves the right to halt work on any project if payments are not made according to the agreed schedule.
3.3 Subscription Billing
If you enroll in a “Houselyt Care” maintenance plan, you authorize us to charge your provided payment method on a recurring monthly or annual basis. You may cancel your subscription at any time with 30 days’ notice, but no pro-rated refunds will be issued for the current billing period.
4. Roofing Services and Site Conditions
4.1 Access to Property
The client must provide Houselyt and its subcontractors with clear access to the driveway and the perimeter of the structure. We are not responsible for delays caused by restricted access.
4.2 Unforeseen Conditions
Roofing work involves the removal of existing materials. If, upon removal of the old roof, we discover rotten decking, structural damage, or hazardous materials (such as asbestos) that were not visible during the initial inspection, additional charges may apply. We will provide a change order for your approval before proceeding with additional work.
4.3 Landscaping and Property
While we take extreme care to protect your property using tarps and barriers, roofing is a heavy construction process. Houselyt is not liable for minor disturbances to lawns, shrubs, or flowers located directly in the “drop zone” of the roof perimeter.
5. Warranties and Disclaimers
5.1 Workmanship Warranty
Houselyt provides a limited warranty on the labor performed, the duration of which will be specified in your Service Agreement. This warranty covers leaks or defects resulting directly from improper installation.
5.2 Manufacturer Warranty
Materials (shingles, metal panels, membranes) are covered by the manufacturer’s warranty. Houselyt will assist the client in filing a claim with the manufacturer but is not responsible for the failure of materials produced by third parties.
5.3 Exclusion of Damages
Houselyt is not responsible for damages caused by:
Acts of God (lightning, hurricanes, tornadoes, hail).
Unauthorized repairs or modifications made by the homeowner or third parties.
Settling of the building structure.
6. Insurance Claims Assistance
If you are engaging Houselyt for storm damage restoration, we may assist you in documenting the damage for your insurance provider. However:
You remain the primary party responsible for payment to Houselyt.
We do not guarantee that your insurance company will approve the claim or cover the full cost of the project.
The client is responsible for paying any insurance deductibles as required by law.
7. Limitation of Liability
To the maximum extent permitted by law, Houselyt shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, even if advised of the possibility of such damages. Our total liability for any claim arising out of our services shall not exceed the total amount paid by you to the Company for that specific project.
8. Intellectual Property
All content on houselyt.com, including text, logos, graphics, and images, is the property of Houselyt and is protected by copyright laws. You may not reproduce or distribute any content without our express written permission.
8.1 Photo Rights
Houselyt reserves the right to take “Before and After” photos of the exterior of your property for marketing and portfolio purposes. We will never disclose your specific street address or internal home details without consent.
9. Indemnification
You agree to indemnify and hold harmless Houselyt, its officers, employees, and subcontractors from any claims, damages, or expenses (including attorney fees) arising out of your breach of these Terms or your violation of any third-party rights.
10. Termination
We reserve the right to terminate your access to the Site or cancel a service contract if:
You provide false or misleading information.
You fail to make timely payments.
You engage in behavior that threatens the safety or well-being of our crew.
11. Dispute Resolution and Governing Law
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state/province where Houselyt is headquartered.
11.2 Arbitration
Any dispute arising out of or relating to these Terms or our services shall be settled by binding arbitration in New York, rather than in court.
12. Force Majeure
Houselyt shall not be held liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to: severe weather, national emergencies, labor strikes, or supply chain disruptions.
13. Entire Agreement
These Terms, along with your signed Service Agreement and our Privacy Policy, constitute the entire agreement between you and Houselyt. Any changes to these Terms must be made in writing and posted on the Site.
